Modal Creative Studio / Just for Creators Collaboration Policy:
Content Ownership Outside Contract Scope
1. Purpose:
This policy outlines the ownership and usage rights of content produced by Modal Creative Studio / Just for Creators that fall outside the scope of the work specified in existing contracts with clients.
2. Scope:
This policy applies to all content produced during collaborations, including but not limited to behind-the-scenes footage, additional shoots, experimental content, or any content created outside the contractual agreement with clients.
3. Ownership of Content:
Unless otherwise agreed upon in writing, all content created by Modal Creative Studio / Just for Creators outside the contracted scope of work shall remain the exclusive property of Modal Creative Studio / Just for Creators. This includes but is not limited to:
Raw footage and edited videos.Photographs, audio recordings, and any other media forms.Any derivative works, including promotional material or content used for internal purposes.
4. Licensing and Usage:
Modal Creative Studio / Just for Creators may grant the client a non-exclusive license to use the additional content, subject to terms agreed upon in a separate agreement. Licensing terms will specify the permitted usage, duration, and any associated costs.
5. Distribution and Promotion:
Modal Creative Studio / Just for Creators reserves the right to use the content for promotional purposes, including but not limited to social media, portfolio showcases, marketing materials, and other media channels.
6. Client Consent and Approvals:
Modal Creative Studio / Just for Creators will seek written consent from the client if the content includes sensitive material or branding that requires client approval. The client has the right to request removal of any content that is deemed inappropriate or damaging to their brand.
7. Modifications to Policy:
Modal Creative Studio / Just for Creators reserves the right to modify this policy at any time. Changes will be communicated to clients and collaborators as necessary.
8. Dispute Resolution:
Any disputes arising from the use or ownership of content shall be resolved through negotiation.
If unresolved, the matter may be escalated to mediation or legal proceedings as per the terms outlined in the contract.
